AppropriateAlternativeMeansArticle 14(3). Which alternative means are "appropriate" for blind and visually impaired persons is an open standard: the Regulation gives no list, and closing it by one would narrow the provision1internal
EffectiveProportionateDissuasiveArticle 16(3). Whether sanctions are "effective, proportionate and dissuasive" is an open standard: the Regulation defines none of the three and sets no floor1internal
ReasonableRelationToWaitingTimeArticle 9(1)(a). What stands in a "reasonable relation to the waiting time" is an open standard: the Regulation fixes neither an amount nor a schedule1internal
ReasonablyExpectsStandardArticles 4(1) and 6(1). Whether the carrier "reasonably expects" to deny boarding or a delay is an open standard: the Regulation fixes neither a probability nor a moment at which the expectation becomes reasonable1internal
ReducedMobilityStandardArticle 2(i). Whether a person's situation "needs special attention and adaptation to the person's needs of the services made available to all passengers" is an open standard: the list of causes is expressly non-exhaustive ("any other cause of disability")1internal
SevenDayReimbursementStartArticle 8(1)(a). The seven-day period for reimbursement has no starting point in the text: it may run from the cancellation, from the passenger's claim or from the moment the passenger chose reimbursement. The formalisation reads it from the choice, because before the choice no duty to reimburse has arisen1internal
